The High Court on Wednesday will hear Congress vice president Rahul Gandhi’s request to quash the defamation case filed against him by an activist of the RSS over his comments that the organization was responsible for the assassination of Mahatma Gandhi’s.
He informed the High Court he had never accused RSS of the assassination of Mahatma Gandhi and only put the blame on the Hindu organization’s “dangerous philosophy” and the “people connected to it.” The complaint was made by Mahadev Kunte, who is said to be an RSS activist. In his charge, Kunte mentioned that Gandhi sought to tarnish the reputation of the RSS through his language. Following the charge, the magistrate issued an order requesting Gandhi’s presence. The case against Gandhi has stayed on the 7th of May 2015.
The RSS is the political mentor of BJP, the ruling party. The case against Mr. Gandhi is for defamation because of a public statement he made in 2014 during his campaign for an election in Maharashtra; that was lost by his party.
Gandhi was reported declaring that the “RSS people killed Gandhi.” Today, his attorney, former union minister Kapil Sibal, informed judges that Mr. Gandhi hadn’t faulted the RSS for the killing of the Father of the Country, but some “individuals connected with RSS.”
Gandhi went the high court in May 2015 requesting an overturn in the Bombay high court order. The court dismissed his plea to quash the defamation suit since the same bench was dealing with another petition submitted by Gandhi, challenging the legality of the defamation act under the Indian Penal Code (IPC).
Gandhi’s counsel informed the tribunal he was within his right to free speech. They’ve maintained the criticism is moved and malicious, and that it should be quashed.
